Jimmychoolondon.com

TransferWIPO-indexed · informational, not legal advice

The Panel ordered transfer of <jimmychoolondon.com> to J. Choo Limited. It found the domain confusingly similar to the registered JIMMY CHOO mark because it incorporated the mark with only the geographic term “london”; found no rights or legitimate interests after the Complainant made a prima facie case that went unrebutted; and found bad-faith registration and use because the domain was used commercially to sell shoes, clothing, handbags, and other goods competing with the Complainant’s products, creating confusion as to source, affiliation, authorization, or licensing.

Westmore Insight

The decision illustrates a conventional trademark-plus-geography and competing-commercial-use fact pattern. The geographic term “london” did not prevent confusing similarity, while the sale of goods competing with the trademark owner’s products supplied a direct basis for finding intentional commercial confusion under UDRP paragraph 4(b)(iv).

A. Thornton & Co.。 2. 争议域名及注册机构 本案所争议的域名是<jimmychoolondon.com>。 投诉人请求专家组裁定将争议域名<jimmychoolondon.com>转移给投诉人。
