WIPO · Case No. D2011-2204

Diajeo.com

TransferWIPO-indexed · informational, not legal advice

The Panel ordered transfer of <diajeo.com> to Diageo PLC. It found the domain confusingly similar to the DIAGEO mark because the substitution of “j” for “g” was visually and phonetically minor. The Respondent had no demonstrated rights or legitimate interests and used the domain for a website promoting competing alcoholic beverages. The Panel concluded that this use intentionally attracted Internet users for commercial gain through confusion and fell within UDRP paragraph 4(b)(iv).

Westmore Insight

This decision illustrates a straightforward single-letter typo case in which the nature of the associated website reinforced all three UDRP elements. The domain’s close visual and phonetic resemblance to DIAGEO established confusing similarity, while its use to promote alcoholic beverages supported both the absence of a legitimate interest and bad faith commercial targeting.

WIPO Arbitration and Mediation Center
