Axa-society.com

TransferWIPO-indexed · informational, not legal advice

The Panel ordered transfer of axa-society.com to AXA SA. It found the domain confusingly similar to the AXA trademark because it incorporated AXA in its entirety and the added term “society” did not prevent confusing similarity. The Complainant established a prima facie case that the Respondent lacked rights or legitimate interests, which the non-responding Respondent did not rebut. Given the AXA mark’s very high reputation, the Respondent’s incorporation of the complete mark, and the passive holding of the domain at an inaccessible website, the Panel found bad-faith registration and use.

Westmore Insight

The case illustrates how passive holding can satisfy the bad-faith-use requirement when combined with a highly reputed mark, complete incorporation of that mark into the domain, longstanding prior rights, and the absence of any respondent explanation. It also confirms that adding an ordinary term such as “society” does not avoid confusing similarity where the trademark remains clearly recognizable.

ARBITRATION AND MEDIATION CENTER
