Virbac-us.shop

TransferWIPO-indexed · informational, not legal advice

The Panel ordered transfer of <virbac-us.shop> to Virbac S.A. It found the domain confusingly similar to the VIRBAC mark because the addition of the geographic abbreviation “us” did not prevent confusing similarity and the “.shop” generic Top-Level Domain was disregarded. The Complainant established a prima facie case that the Respondent lacked rights or legitimate interests, which the non-responding Respondent did not rebut. On bad faith, the Panel relied on the Complainant’s earlier trademark rights and evidence that the domain had resolved to a website displaying the Complainant’s trademark and logo and selling veterinary products identical or similar to those offered by the Complainant.

Westmore Insight

This decision illustrates a straightforward trademark-plus-geographic-term dispute in which the website content strongly connected the domain to the complainant’s field of business. The combination of the VIRBAC mark, the “us” geographic abbreviation, a retail-oriented “.shop” gTLD, and a website displaying the Complainant’s branding and selling veterinary products supported findings on all three UDRP elements. It also shows that a panel may accept an English complaint without translation while still selecting Chinese as the language of the proceeding and decision.
