Cagaronne.com + 96 more domains

TransferWIPO-indexed · informational, not legal advice

The Panel consolidated the disputes concerning 97 one-letter variants of the CIGARONNE mark, determined that English would be the language of the proceeding, and found all three UDRP elements established. It held that the domains were confusingly similar, that the Respondent lacked rights or legitimate interests, and that both the domains used for imitation product-authentication pages and the passively held domains were registered and used in bad faith. Transfer of all 97 disputed domain names was ordered.

Westmore Insight

This decision illustrates how a large portfolio of typographical variants may be consolidated and assessed as a coordinated scheme where common naming patterns, compressed registration timing, uniform subdomain structures, and replicated website content point to common control. It also shows passive holding being evaluated in the context of demonstrated active misuse across the broader portfolio rather than in isolation.

The disputed domain name <cigaronnne.com> is registered with Alibaba Cloud Computing Ltd. d/b/a HiChina (www.net.cn). eName Technology Co., Ltd., NameSilo, LLC, Amazon Registrar, Inc., and Alibaba Cloud Computing Ltd. d/b/a HiChina (www.net.cn) are collectively and separately referred to below as the “Registrar”. 3. Procedural History The Complaint was filed in English with the WIPO Arbitration and Mediation Center (the “Center”) on June 29, 2026, originally against 68 disputed domain names. On July 1, 2026, the Center transmitted by email to the Registrar requests for registrar verification in connection with the 68 disputed domain names. On July 1 and 2, 2026, the Registrar transmitted by email to the Center verification responses disclosing registrant and contact information for the disputed domain names that differed from the named Respondents (shielded by a privacy or proxy registration service) and contact information in the Complaint. The Center also sent an email communication to the Complainant on July 9, 2026, informing it that three of the domain names were available for registration. On August 3, 2026, the Complainant provided the Center with a list of disputed domain names that it wished to add to the current proceeding. On the same day, the Center requested that the Complainant submit an updated Complaint incorporating the additional disputed domain names. The Complainant filed an amended Complaint in English on August 6, 2026 against a total of 100 disputed domain names. On the same day, the Center transmitted by email to the Registrar requests for registrar verification in connection with the newly-added disputed domain names. On August 6, 7, 10, and 24, 2026, the Registrar transmitted by email to the Center verification responses disclosing registrant and contact information for the newly-added disputed domain names that differed from the named Respondents (Unknown Registrant(s), privacy/proxy service(s), and any underlying registrant(s) disclosed through registrar verification) and contact information in the Complaint. On August 18, 2026, the Complainant confirmed that it wished to withdraw the Complaint as regards three domain names that it had succeeded in registering. On August 24, 2026, the Center informed the Parties in Chinese and English that the language of the Registration Agreements for some of the disputed domain names, including <cigaronnne.com>, is Chinese. On September 1, 2026, the Complainant confirmed its request that English be the language of the proceeding. The Respondents did not submit any comment on the language of the proceeding. The Center sent an email communication to the Complainant on August 24, 2026, with the registrant and contact information of nominally multiple underlying registrants revealed by the Registrar, requesting the Complainant to either file separate complaints for the disputed domain names associated with different underlying registrants or alternatively, demonstrate that the underlying registrants are in fact the same entity and/or that all domain names are under common control. The Complainant filed an amendment to the Complaint in English on September 1, 2026. The Center verified that the Complaint together with the amended Complaint and amendment to the Complaint satisfied the formal requirements of the Uniform Domain Name Dispute Resolution Policy (the “Policy” or “UDRP”), the Rules for Uniform Domain Name Dispute Resolution Policy (the “Rules”), and the WIPO Supplemental Rules for Uniform Domain Name Dispute Resolution Policy (the “Supplemental Rules”). In accordance with the Rules, paragraphs 2 and 4, the Center formally notified the Respondents in Chinese and English of the Complaint, and the proceedings commenced on September 4, 2026. In accordance with the Rules, paragraph 5, the due date for Response was September 24, 2026. Email communications were received on September 5, 2026 from the contact email address of xiang zhang, holder of the disputed domain name <cigaranne.com>. The Center informed the Parties of the commencement of the panel appointment process on September 30, 2026. page 3 The Center appointed Matthew Kennedy as the sole panelist in this matter on October 2, 2026. The Panel finds that it was properly constituted. The Panel has submitted the Statement of Acceptance and Declaration of Impartiality and Independence, as required by the Center to ensure compliance with the Rules, paragraph 7. 4. Factual Background The Complainant is an Armenian tobacco company founded in 1999 and wholly owned by Pogossian Semen Hmayaki. Mr. Pogossian holds multiple International trademark registrations, including the following: − number 721636 for CIGARONNE, registered on July 26, 1999, designating multiple jurisdictions, including China, and specifying goods in class 34; and − number 1452856 for a figurative AAA CIGARONNE mark, registered on December 4, 2018, designating multiple jurisdictions, including China, and specifying goods in class 34. The above trademark registrations are current. The Complainant operates a website in connection with the domain name <cigaronne.com> where it makes available information about itself and its products. The website includes a service associated with the sub-domain <qr.cigaronne.com> (the “product authentication page”) that allows Internet users to scan a QR code and check whether their CIGARONNE product is original. The Respondents are identified as various individuals and a company, all based in China. The disputed domain names were registered on the dates and in the names shown below: Disputed domain name Date of registration Registrant name <cigaronnne.com> March 18, 2026 叶家鹏 (ye jia peng) <cigaronte.com> May 25, 2026 Mingde Thunder <cigaronue.com> May 25, 2026 Mingde Thunder At the time when the Complaint was filed, 25 disputed domain names were passively held, i.e., the 24 disputed domain names held by “Liu Xin Liang (刘新良)”, which did not resolve to active webpages, and the disputed domain name held by “xiang zhang”, which resolved to an Internet Content Provider (“ICP”) holding page. The other 72 disputed domain names resolved to a website that prominently displayed the CIGARONNE mark in the same stylized script as the figurative AAA CIGARONNE mark and purported to be the Complainant’s product authentication page. At the time of this Decision, almost all disputed domain names are passively held, the exceptions being two disputed domain names held by “叶家鹏 (ye jia peng)” and Alen Wei, which continue to resolve as before. 5. Parties’ Contentions A. Complainant The Complainant contends that it has satisfied each of the elements required under the Policy for a transfer of the disputed domain names. Notably, the Complainant contends that the disputed domain names are confusingly similar to the CIGARONNE marks. The Respondents have no rights or legitimate interests in respect of the disputed domain names. Neither Mr. Pogossian nor the Complainant has licensed, authorized, endorsed, or permitted any of the Respondents to use CIGARONNE or a confusingly similar designation in a domain name or product-authentication service. The active websites associated with the disputed domain names imitate or simulate the Complainant’s product authentication process and do not constitute a bona fide offering, legitimate noncommercial use, or fair use. The disputed domain names have been registered and are being used in bad faith. The systematic registration of 100 typographical variants 1 of the distinctive CIGARONNE mark demonstrates deliberate targeting and knowledge of the Complainant’s rights. The unauthorized or simulated CIGARONNE authentication experience is designed to attract users seeking the Complainant’s legitimate service by creating confusion as to source, sponsorship, affiliation, or endorsement within the terms of paragraph 1 Three domain names were subsequently removed from the proceeding. page 6 4(b)(iv) of the Policy. Passively-held variants form part of the same scheme and do not preclude bad faith. B. Respondents Apart from email communications with one showing empty content and the other one consisting of the word “what?” sent from xiang zhang’s contact email address, the Respondents did not formally reply to the Complainant’s contentions. 6. Discussion and Findings 6.1 Procedural Issues A. Consolidation: Multiple Respondents The amended Complaint was filed in relation to nominally different domain name registrants. The Complainant alleges that the domain name registrants are the same entity or mere alter egos of each other, or under common control. The Complainant requests the consolidation of the Complaint against the multiple disputed domain name registrants pursuant to paragraph 10(e) of the Rules. The disputed domain name registrants did not comment on the Complainant’s request. Paragraph 3(c) of the Rules states that a complaint may relate to more than one domain name, provided that the domain names are registered by the same domain name holder. In addressing the Complainant’s request, the Panel will consider whether (i) the disputed domain names or corresponding websites are subject to common control; and (ii) the consolidation would be fair and equitable to all Parties. See WIPO Overview of WIPO Panel Views on Select UDRP Questions (“WIPO Overview 3.1”), section 4.11.2. As regards common control, the Panel notes that 70 disputed domain names are registered in the same name (“Mingde Thunder”) and that each of the other 27 disputed domain names was registered within a short time of them. The disputed domain names follow a naming pattern that produces one-letter variants of the CIGARONNE mark, either adding a letter after the mark, adding a letter in the mark, or substituting a letter in the mark. One Respondent, Liu Xin Liang (刘新良) used all three techniques to create disputed domain names while the other Respondents used one or two of the same techniques. Those disputed domain names that resolved to an active webpage directed to subdomains structured in the same way, i.e., “qr.[disputed domain name]”, and mimicked the same product authentication page on the Complainant’s website. In view of these circumstances, the Panel finds it likely that the disputed domain names and associated websites are under common control. As regards fairness and equity, the Panel sees no reason why consolidation of the disputes would be unfair or inequitable to any Party. Accordingly, the Panel decides to consolidate the disputes regarding the nominally different disputed domain name registrants (referred to below as “the Respondent”) in a single proceeding. B. Language of the Proceeding The language of the Registration Agreements for the disputed domain names registered with NameSilo, LLC and Amazon Registrar, Inc. is English, while the language of the Registration Agreements for the disputed domain names registered with eName Technology Co., Ltd. and Alibaba Cloud Computing Ltd. d/b/a HiChina (www.net.cn) is Chinese. Pursuant to the Rules, paragraph 11(a), in the absence of an agreement between the parties, or unless specified otherwise in the registration agreement, the language of the administrative proceeding shall be the language of the registration agreement. page 7 The Complaint, the amended Complaint and the amendment to the Complaint were filed in English. The Complainant requested that the language of the proceeding be English for several reasons, including the fact that its evidence is in English, and the disputed domain names are in Latin script. Despite the Center having sent an email regarding the language of the proceeding and notified the Complaint in Chinese as well as English, the Respondent did not make any submissions with respect to the language of the proceeding or indicate any interest in otherwise participating in this proceeding. Further, the Registration Agreements for many disputed domain names are in English, and the Panel has found that all the disputed domain names are under common control. In exercising its discretion to use a language other than that of the registration agreement, the Panel has to exercise such discretion judicially in the spirit of fairness and justice to both parties, taking into account all relevant circumstances of the case, including matters such as the parties’ ability to understand and use the proposed language, time and costs. See WIPO Overview 3.1, section 4.5.1. Having considered all the matters above, the Panel determines under paragraph 11(a) of the Rules that the language of the proceeding shall be English. 6.2 Substantive Issues Paragraph 4(a) of the Policy provides that a complainant must prove each of the following elements with respect to each disputed domain name: (i) the disputed domain name is identical or confusingly similar to a trademark or service mark in which the complainant has rights; and (ii) the respondent has no rights or legitimate interests in respect of the disputed domain name; and (iii) the disputed domain name has been registered and is being used in bad faith. The burden of proof of each element is borne by the Complainant. A. Identical or Confusingly Similar It is well accepted that the first element functions primarily as a standing requirement. The standing (or threshold) test for confusing similarity involves a reasoned but relatively straightforward comparison between the Complainant’s trademark and the disputed domain names. See WIPO Overview 3.1, section 1.7. According to the evidence presented by the Complainant, its sole shareholder is Mr. Pogossian, who holds registered rights in respect of the CIGARONNE mark, among others. The Panel infers from the Complainant’s relationship to Mr. Pogossian that the Complainant is authorized to file the Complaint and holds rights in that mark sufficient for the purposes of the standing requirement of the Policy. See WIPO Overview 3.1, sections 1.2.1 and 1.4. Of the 97 disputed domain names, 47 wholly incorporate the CIGARONNE mark, adding a single letter after the mark. The Panel finds the mark recognizable within each of these 47 disputed domain names. The other 50 disputed domain names contain misspellings of the CIGARONNE mark, of which eight add a letter in the mark and 42 substitute a letter in the mark. Each of these 50 domain names contains sufficiently recognizable aspects of the mark to be considered confusingly similar to the mark. The only other element in each disputed domain name is a generic Top-Level Domain (“gTLD”) extension (either “.com” or “.net”) which, as a standard requirement of domain name registration, may be disregarded in the assessment of confusing similarity for the purposes of the Policy. page 8 Accordingly, all 97 disputed domain names are confusingly similar to the mark for the purposes of the Policy. See WIPO Overview 3.1, sections 1.7, 1.8, 1.9, and 1.11.1. Therefore, the Panel finds the first element of the Policy has been established. B. Rights or Legitimate Interests Paragraph 4(c) of the Policy provides a list of circumstances in which the Respondent may demonstrate rights or legitimate interests in a disputed domain name. Although the overall burden of proof in UDRP proceedings is on the complainant, panels have recognized that proving that a respondent lacks rights or legitimate interests in a domain name may result in the difficult task of “proving a negative”, requiring information that is often primarily within the knowledge or control of the respondent. As such, where a complainant makes out a prima facie case that the respondent lacks rights or legitimate interests, the burden of production on this element shifts to the respondent to come forward with relevant evidence demonstrating rights or legitimate interests in the domain name (although the burden of proof always remains on the complainant). If the respondent fails to come forward with such relevant evidence, the complainant is deemed to have satisfied the second element. See WIPO Overview 3.1, section 2.1. In the present case, at least 72 disputed domain names have resolved to websites that prominently displayed the CIGARONNE mark in the same stylized script as the figurative AAA CIGARONNE mark and mimicked the product authentication page on the Complainant’s website. The Complainant submits that neither it nor the trademark owner has licensed, authorized, endorsed, or permitted the Respondent to use CIGARONNE or a confusingly similar designation in a domain name or product authentication service. The other 25 disputed domain names were passively held at the time when the Complaint was filed, and all but two of the 97 disputed domain names are passively held at the time of this Decision. Neither of these uses constitutes a bona fide offering of goods or services for the purposes of the Policy. Nor are they legitimate noncommercial or fair uses of the disputed domain names for the purposes of the Policy. Further, the Registrar has verified that the Respondent’s names are as set out in Section 1 above, none of which resembles any of the disputed domain names. Nothing on the record indicates that the Respondent has been commonly known by the disputed domain names. Having reviewed the available record, the Panel finds the Complainant has established a prima facie case that the Respondent lacks rights or legitimate interests in the disputed domain names. The Respondent has not rebutted the Complainant’s prima facie showing and has not come forward with any relevant evidence demonstrating rights or legitimate interests in the disputed domain names such as those enumerated in the Policy or otherwise. Based on the record, the Panel finds the second element of the Policy has been established. C. Registered and Used in Bad Faith The Panel notes that, for the purposes of paragraph 4(a)(iii) of the Policy, paragraph 4(b) of the Policy establishes circumstances, in particular, but without limitation, that, if found by the Panel to be present, shall be evidence of the registration and use of a domain name in bad faith. The fourth of these is as follows: “(iv) by using the [disputed] domain name, [the respondent has] intentionally attempted to attract, for commercial gain, Internet users to [the respondent’s] website or other online location, by creating a likelihood of confusion with the complainant’s mark as to the source, sponsorship, affiliation, or endorsement of [the respondent’s] website or location or of a product or service on [the respondent’s] website or location.” page 9 In the present case, the disputed domain names were registered in 2026, years after the registration of the Complainant’s trademark, including in China, where the Respondent is based. Each of the disputed domain names either wholly incorporates the CIGARONNE mark with an additional letter after the mark, or consists of a one-letter variation of that mark, either adding a letter in the mark or substituting a letter in the mark. The disputed domain names have no meaning other than as approximations of the mark. Those that were used actively resolved to websites that displayed the CIGARONNE mark in the same stylized script as the figurative AAA CIGARONNE mark and mimicked the Complainant’s product authentication page. In view of these circumstances, the Panel finds that the Respondent knew of the Complainant and its CIGARONNE mark at the time when it registered the disputed domain names. As regards use, at least 72 disputed domain names have resolved to websites that prominently displayed the CIGARONNE mark in the same stylized script as the figurative AAA CIGARONNE mark and mimicked the Complainant’s product authentication page. Given the Panel’s findings in Section 6.2B above, the Panel finds that by using these 72 disputed domain names, the Respondent has intentionally attempted to attract, for commercial gain, Internet users to its websites by creating a likelihood of confusion with the Complainant’s mark as to the source, sponsorship, affiliation, or endorsement of the Respondent’s websites or of a product authentication service on those websites, within the terms of paragraph 4(b)(iv) of the Policy. The other 25 disputed domain names do not currently resolve to any active website. Prior UDRP panels have found that the non-use of a domain name would not by itself prevent a finding of bad faith under the doctrine of passive holding. To the contrary, in looking at the totality of circumstances in each case, panels have found that the registration and non-use of a domain name can still constitute bad faith for purposes of the Policy. See WIPO Overview 3.1, section 3.3. Having reviewed the available record, the Panel notes that the disputed domain names have no meaning other than as approximations of the mark. There appears to be no purpose for them other than to divert Internet users seeking the Complainant or its goods or services. In the Panel’s view, the most likely intended use of these 25 disputed domain names is the same as, or similar to, the use to which the other 72 disputed domain names have been actively put, i.e., to resolve to a site mimicking the Complainant’s site or the product authentication service offered there. Accordingly, the Panel finds that in the circumstances of this case the passive holding of the 25 disputed domain names does not prevent a finding of bad faith under the Policy. The Panel takes note that the use of many of the disputed domain names has now changed and that all but two are now passively held. This change in use does not alter the Panel’s conclusion; if anything, it is a further indication of bad faith. Therefore, the Panel finds that the Complainant has established the third element of the Policy. 7. Decision For the foregoing reasons, in accordance with paragraphs 4(i) of the Policy and 15 of the Rules, the Panel orders that the disputed domain names <cagaronne.com>, <caigaronne.com>, <cbgaronne.com>, <cggaronne.com>, <ciaaronne.com>, <cigaaonne.com>, <cigafronne.com>, <ciganonne.com>, <cigarbnne.com>, <cigarhnne.com>, <cigarkonne.com>, <cigarlnne.com>, <cigarocne.com>, <cigarognne.com>, <cigarohne.com>, <cigarohnne.com>, <cigarongne.com>, <cigaronhe.com>, <cigaronlne.com>, <cigaronna.com>, <cigaronnee.com>, <cigaronner.com>, <cigaronnes.com>, <cigaronnj.com>, <cigaranne.com>, <cigaronae.com>, <cigaronge.com>, <cigaronie.com>, <cigaronje.com>, <cigaronke.com>, <cigaronnb.com>, <cigaronnb.net>, <cigaronnc.com>, <cigaronnc.net>, <cigaronnd.com>, <cigaronnd.net>, <cigaronnea.com>, <cigaronnea.net>, <cigaronneb.com>, <cigaronneb.net>, <cigaronnec.com>, <cigaronnec.net>, <cigaronned.com>, <cigaronned.net>, <cigaronnef.com>, <cigaronnef.net>, <cigaronneg.com>, <cigaronneg.net>, <cigaronneh.com>, <cigaronneh.net>, <cigaronnei.com>, <cigaronnei.net>, <cigaronnej.com>, <cigaronnej.net>, <cigaronnek.com>, <cigaronnek.net>, <cigaronnel.com>, <cigaronnel.net>, <cigaronnem.com>, <cigaronnem.net>, <cigaronnen.com>, <cigaronnen.net>, <cigaronneo.com>, <cigaronneo.net>, <cigaronnep.com>, <cigaronnep.net>, <cigaronneq.com>, <cigaronneq.net>, <cigaronnet.com>, page 10 <cigaronnet.net>, <cigaronneu.com>, <cigaronneu.net>, <cigaronnev.com>, <cigaronnev.net>, <cigaronnew.com>, <cigaronnew.net>, <cigaronnex.com>, <cigaronnex.net>, <cigaronney.com>, <cigaronney.net>, <cigaronnf.com>, <cigaronnf.net>, <cigaronng.com>, <cigaronng.net>, <cigaronnh.com>, <cigaronnh.net>, <cigaronni.com>, <cigaronni.net>, <cigaronnl.com>, <cigaronnl.net>, <cigaronoe.com>, <cigaronqe.com>, <cigaronse.com>, <cigaronte.com>, <cigaronue.com>, <cigarcnne.com>, and <cigaronnne.com> be transferred to the Complainant. /Matthew Kennedy/ Matthew Kennedy Sole Panelist Date: October 12, 2026
